The governance and regulation of Artificial Intelligence (AI) have become pivotal topics of discussion worldwide as nations grapple with the balance between fostering innovation and safeguarding public interests. In recent years, the focus has shifted from social safety and inclusivity towards economic prosperity. Despite this shift, only a select few regions, including China, the European Union, Canada, Korea, Peru, and the United States, have implemented laws to regulate AI. Notably, in the U.S., President Donald Trump has revoked former President Joe Biden’s Executive Order related to AI utilization.

In contrast, many nations have opted to release policy documents instead of formal laws, detailing their strategic intentions and roadmaps for AI’s integration into socio-economic frameworks. These documents emphasize inclusivity, ethical standards, and sustainability. Approximately 85 countries, including the African Union, have published national AI strategy documents.

India’s Unique Approach

India stands apart in its approach to AI governance. Unlike other countries, India lacks an officially sanctioned National AI Strategy or specific AI regulation. Instead, its efforts are concentrated on a government mission aimed at promoting AI adoption and development. The 2018 “National Strategy for Artificial Intelligence” by NITI Aayog, although comprehensive in its recommendations, remains a non-binding directive. The IndiaAI mission, built on seven pillars, seeks to nurture a skilled and trustworthy AI ecosystem, with several projects, such as foundational AI models, underway.

An advisory group is tasked with formulating governance recommendations, though their potential incorporation into official policy remains uncertain. India’s approach offers flexibility, allowing adaptability in response to technological changes and geopolitical shifts. However, it also leaves gaps in articulating India’s AI vision, priorities, and accountability measures. The initiatives could deviate from planned paths, and there is a risk of over-reliance on individual leadership.

Growing AI Adoption and Existing Challenges

While AI development is predominantly centered in the U.S., EU, U.K., and China, India is witnessing a burgeoning AI adoption rate. However, as AI becomes more pervasive, concerns arise regarding discrimination, privacy breaches, and cybersecurity threats. The current voluntary guardrails lack clarity, and there is limited public awareness about algorithmic usage and effectiveness, especially in critical sectors like healthcare, banking, and education.

Civic discourse on AI-related social issues is minimal, despite the increased incidents of social harm linked to AI-generated content on social media in recent years. This lack of dialogue is a pressing concern as India navigates its AI journey.

Drawing Lessons from Global Models

India can draw valuable lessons from international practices in AI governance. The Digital Personal Data Protection (DPDP) Act, 2023, mirrors the centralized, comprehensive model of the EU’s GDPR and China’s Personal Information Protection Law. Conversely, the U.S. adopts a decentralized, sector-specific approach, while China implements targeted laws for specific AI types or use cases.

India might develop a hybrid model building on the framework outlined by the DPDP Act, 2023. Establishing an AI policy could serve as a short-term objective, providing a platform for piloting enforcement tools before formal legislation. Insights from global AI policies highlight critical areas for inclusion: India’s AI vision, capacity-building strategies, responsible use ethical guidelines, and priority sectors for AI-driven economic growth.

Public engagement on AI’s societal role is urgently needed. A national discussion can help align AI policies with societal values and address potential disruptions in labor markets and personal privacy.
