Sag-Aftra, the prominent actors’ union, has lodged a formal complaint against the use of artificial intelligence (AI) in recreating the voice of Star Wars villain Darth Vader within the popular video game Fortnite. The union accuses Llama Productions, a subsidiary of Epic Games, of substituting human performers with AI technology without proper communication or negotiation.

Unilateral Changes Alleged

The union’s complaint, submitted to the US National Labor Relations Board (NLRB), alleges that Epic Games made “unilateral changes to terms and conditions of employment” by implementing AI-generated voices. This, according to the union, constitutes a failure by the employer to “bargain in good faith.” The changes were reportedly made without informing the union or allowing for negotiation, raising significant concerns about labor practices.

Darth Vader in Fortnite

In Fortnite, players can interact with Darth Vader, strategizing with the iconic Sith Lord using their voices. Epic Games has touted the AI’s capability to respond conversationally, highlighting that the recreation of Darth Vader’s voice was done with the agreement of the estate of James Earl Jones, the late actor known for his portrayal of the character in the Star Wars films.

The actor’s family stated that James Earl Jones believed the voice of Darth Vader was integral to the Star Wars narrative and expressed enthusiasm for fans experiencing it through this collaboration with Fortnite. “We hope that this collaboration with Fortnite will allow both longtime fans of Darth Vader and newer generations to share in the enjoyment of this iconic character,” they added.

Protecting Actors’ Rights

Sag-Aftra emphasized the importance of allowing its members and their estates to control the usage of digital replicas. The union seeks to ensure that actors benefit from these technological advancements. “We must protect our right to bargain terms and conditions around uses of voice that replace the work of our members,” the union stated.

Growing Concerns Over AI

The complaint comes amidst increasing anxiety among video game and voice actors about AI’s potential to reduce or entirely replace their work. Prominent Hollywood actors, including Scarlett Johansson, have expressed apprehension regarding the manipulation of their digital likeness through generative AI.

Sag-Aftra has been actively negotiating for terms that protect video game voice actors’ rights since strikes began last year. Union members have refused to work with companies like Activision, Disney, Warner Bros, and EA over issues related to AI and digital replicas.

Potential Misuse of AI Technology

Concerns about the misuse of AI-powered technology are also prevalent. Wired magazine reported that Fortnite players have already discovered methods to make Darth Vader’s character use inappropriate language in voice chats, illustrating the broader implications of integrating AI into interactive media.

The situation underscores the tension between innovation in gaming technology and the rights of actors who bring beloved characters to life. As the industry continues to evolve, finding a balance that respects both technological advancement and the livelihoods of performers remains crucial.
